British Citizen wishing to move to the UK with non EU child

Post by DNASA » Tue Jan 19, 2016 4:13 pm

Hi,

I can't seem to find any info on this.

A UK Citizen I know wishes to move to the UK with their non-EU child, with the intention of getting employment in the UK to satisfy the financial requirement to bring her non-EU spouse into the UK.

Is there a possible way of doing this?

Thanks,

DNASA

How did you obtain British citizenship?

You would need to show sole responsibility if you are bringing the child only and not the other parent.

Thanks for the reply.

It's not a me, it's a family member for whom I'm trying to find information.

She is British Citizen by Decent. Both her parents were born in the UK.

I've read this sole responsibility rule, but seems that it would be counter productive or difficult to prove considering what they are trying to achieve, namely for her to be able to work in the UK to try to satisfy the financial requirement to bring her husband in on a Spouse Visa. And it's not practical to separate a child from it's mother for a lengthy period.

Thanks...

Has she thought about coming back via an EU country using the Surinder Singh route (google it).

Much cheaper application fees, no financial requirements etc.

Unlikely she would get a visa for the child if the other parent is not applying at the same time as the child.

Thanks for your advice,

I have told her about this route.

I was just trying to see if she had any other options, as she has many family members(Grandmother, Aunts, cousins, sisters etc.) in the UK and would have liked to move directly to the UK if possible to be close to her family.

Thanks again....
