FLR (M) Section 2

Dear sirs,
I need your precious advice on the following issues:

Im on tier 2 dependent visa as a Partner(Spouse) , I've been living in the UK for last 7 months.
My husband got ILR (10 years route about 1.5 months ago.
Now Im applying for FLR(M) for the first time from within the UK, but on SECTION 2 :
I'm bit confused about 2.2 & 2.3

I understand that my husband was NOT settled person before when I got my first entry clearance as a TIER-2 Partner.
therefore I answered YES to 2.2 ...am I right ??

Then again 2.3 is even more confusing ...should I tick on FIRST box or THIRD box ??

First box suggest SETTLED person which he was NOT !
Third box suggest PARTNER ....which I was when I got my first entry clearance.

Im absolutely puzzled....Please HELP...SOS.
