Hi,

This one is complex so bear with me.

My UK Ancestry visa started in 07/2011. My daughter has a UK Ancestry visa linked to mine, starting dates the same, etc.

Since then, the 6 April 2015 section 65 of the Immigration Act 2014 changes have meant that I could apply for citizenship by registration using form UKF. My father was British but my parents weren't married so I wasn't eligible before.

The complicated part: I obviously no longer have to apply for ILR because I've registered with form UKF **BUT** my daughter hasn't. How do we deal with this?

More complicated bits:

Her father is British. He was born abroad but was registered at the time of his birth. His parents were expats at the time but returned to the UK when he was young.

We're coming up to the time where we have to begin the ILR (or other?) process for her but I'm really concerned that as I'm not applying and she's on my visa it will cause problems with the Home Office.

Can anyone offer any advice? It would be greatly appreciated.

Is her father named on her birth certificate?

Is her father in the UK living with you as a family unit?

Hi CR001,

Yes, he's named on her birth certificate but no, we've been apart since she was an infant. It's just the two of us. :)

That might present a problem as once you get your UKF approval, her visa will technically be void.

You could look at Set(F) or look at registering her under section 3(2) or 3(5) or the nationality act.

You would think that, given the very unusual circumstances, they would show some discretion in the matter, no?

It certainly wasn't my fault that my parents weren't married, nor that they changed the laws last year... :shock:

sigh... this stuff is never easy, is it? :(
