Extention to spouse visa - clarity needed

Post by nindisp » Mon Jul 11, 2016 9:50 pm

Hi - hoping to get some clarity on what I need and what I do not for the extension application.

My wife's initial 2.5yrs ends on 6th Nov 2016. She has an Indian passport (& also a PR from Norway).
I am a British citizen (naturalised back in 2009).

Just want some clarity and confirmation on the process:
1.Apply by filling in FLR(M)
2. Meet the requirements (relationship/suitability/immigration staus/financial/English language)

Q1:
Does she need to pass a new English language test? She already did an IELT when she completed the initial application to come to the UK. Will this suffice, or is there an expiry date on this test?

Q2:
Is there anything specific required for the BRP, beyond going to the appointment?

Q3:
Is the life in the UK test needed, or is this only when she gets to the end of this extension and applies for a PR?

Q4:
Do they need and keep the passport for the duration of the application, as she has travel plans in mid October?

Does anyone have a full list of documents that they need, or a website link which clearly lists them?

Many Thanks,
Nindi

1. If she applies after 1st October, she needs the new A2 level English test from one of the HO approved test providers. English tests do expire after 2 years.

2. Depends if she applies in person or by post.

3. No, LIUK is not needed for a FLR(M) extension. Only needed for ILR.

4. Again, depends if she applies by post or in person. If she applies by post, she has to send her passport.

Page 62/63 of the FLR(M) form gives a good list of examples HO want to see, in addition to 6 months payslips and 6 months corresponding bank statements.

Were you with her in Norway?

Yes i was in Norway.

On the language test, we will be applying before Oct16, however her IELTS exam was passed over 2years ago already. So would she need to redo IELTS or the A2 (which appears to kick into effect in Oct16).

If you were a British citizen working in Norway, then wouldn't the SS route have been simpler and less expensive?
