Spouse VISA resubmission/director/savings

Post by stevenlee » Tue Jul 19, 2016 4:20 pm

Hello,

My question is simple, I have previously failed a Spouse visa application for my wife on the basis that I did not supply enough documents for being a director of a company despite providing enough evidence via salary and savings.

Would I be able to resubmit an application for savings alone as I have enough savings. However the source of the savings were from payments from dividends of my own company and the money has since sat idle in an account for 6 months.

Would I be forced go the director route simply because I am one? or can I choose to go via savings alone?

Kind Regards
Steven Lee

I cannot give a clear answer but just some thoughts.
Even if you choose to go with savings, you need to explain the source of these savings which are dividends and they are only possible with ltd company. I think it will bring more questions and can cause issues.

You mentioned you did not supply enough documents, why not identify the missing ones and go through director route? HO can probably check whether you are a director, paid all taxes etc, any oustanding tax etc so IMHO better to present the situation as it is.
