PBS dependant or FLR for Spouse of ILR via 10 year route

Post by jkcool » Tue Sep 20, 2016 2:18 pm

Hi,

Here's my history.

Sep 2006 : Entry into UK as student.
Jan 2008 - Feb 2009: Post Study work
Feb 2009 : Got first Tier 2 visa
Dec 2012 : Got married and Wife got PBS Dependent visa in March 2013.
Jul 2013: Got new Tier 2 visa by switching the sponsor.
( But had a gap of 60+ days between the switch. My ILR application in July 2014 was rejected because of the gap )

June 2015: Tier 2 visa extended until July 2018.
Sep 2016: Granted ILR in the long term residency route.

My wife (currently working) still has Tier 2 dependent until July, 2018. Will she be eligible to apply for ILR in March 2018 ( 5 years as PBS dependent) ? If she had to switch to FLR, will her counter reset ?

I did my premium appointment on Sep 15, 2016. I did not get my BRP yet. If I had to apply for a visa for my wife, within how many days I need to apply ?

No she won't. As you got ILR based on long residence, your wife will have to switch to FLR(M) and a new 5 year (2 x 2.5 year visas) route to ILR. She loses her time already spent on PBS Dependent.

No specific timeframe, wait for BRP and then submit when you can.

Thank you for the clarifications
What's the normal turn around time for FLR?

For the FLR application, will they send back the passport and current BRP along with the Confirmation letter ?

After enrolling BRP, Is travel permitted with old BRP while the decision is made ?

Is the FLR required only because of long term residence? If my ILR was based on Tier 2 then my wife could have continued until 5 years till 2018.

Apply in person if there is a need for documents/passports.

Risky to travel on her existing BRP if you get ILR LR. She has to submit BRP with FLR(M) application and HO hold on to all documents till decision if you apply by post.
