Moving back to UK

Post by accablues » Thu May 04, 2017 7:31 am

Good Morning everyone,

Hope everyone is in good health and with either less or no visa issues (either way praying for all)

a bit of history, I am a BN currently working in GCC. I moved out of UK end of 2010. Now I am planing to move back with my wife (pak national) and kids (BN). No issues for me and my kids but I need visa for my wife. She came to UK back in 2010 on settlement visa for a short period of time but then we moved out and her settlement visa expired. After that applied for her visit visa which was accepted and we made couple of visits since then

her travel history to UK
1. initially moved to UK on settlement in 2010 but left end of 2010
2. traveled to UK in 2012 (with valid settlement visa)
3. visited UK on visit visa in 2014
4. visited UK on visit visa in 2015

now her visit visa have also expired.

current situation: I am now planning to move back ,which means I need to get visa for my wife. Before , I get in to what paperwork etc I need , I read this on the link given below

http://www.workpermit.com/immigration/u ... -visa-tips

[If you have been together for four years or more outside the UK and you have passed the Life in the UK test, you are eligible for indefinite leave to remain (permanent residence) in the UK without having to live in the UK for two years"

I and my wife have been living together for more than 4 years in Dubai (her residency visa will prove this). Is she eligible for ILR based on the above point - or my understanding of the point is wrong

appreciate if someone can help me on this

thanks in advance

The 4 year concession was withdrawn some years ago. Your wife will have to apply for a Spouse Settlement visa and as the Sponsor you will be required to show that you meet the minimum income level.
1. Relocate to the UK ahead of your wife and she will then be able to apply for her visa once you have 6 months of payslips and the corresponding bank statements showing you are earning £18,600 p.a
OR
2. Have £65,000 (or the equivalent) in savings held in an accessible account for a minimum of 6 months (unless from the sale of a property). Savings can be joint.
OR
3. Show that you have been earning the equivalent of £18,600 in your present country of residence AND have a confirmed offer of employment in the UK, starting within 3 months of arrival and again with the minimum earning level of £18,600 p.a

Your wife will also need to pass the A1 level English test from a Home Office approved test provider and in addition to the visa fee she will have to pay the £600 NHS surcharge.

@ Casa - many thanks for your reply

Agree - I remember there was an option of ILE but that was removed years back, not sure why the work permit website is advertising this option. I have contacted them, will share their answer.

1. Relocate to the UK ahead of your wife and she will then be able to apply for her visa once you have 6 months of payslips and the corresponding bank statements showing you are earning £18,600 p.a

Defo don't want to take up this route - long, risky and don't want to stay without my kids

OR
2. Have £65,000 (or the equivalent) in savings held in an accessible account for a minimum of 6 months (unless from the sale of a property). Savings can be joint.

funds in the local bank account will be considered or only UK banks? and as for currency only £ or any as long as they are in the bank?

OR
3. Show that you have been earning the equivalent of £18,600 in your present country of residence AND have a confirmed offer of employment in the UK, starting within 3 months of arrival and again with the minimum earning level of £18,600 p.a

I have part time offer with nearly same amount - will be joining point 2 with point 3 (if accepted)

Your wife will also need to pass the A1 level English test from a Home Office approved test provider and in addition to the visa fee, she will have to pay the £600 NHS surcharge.

I have sent UKNARIC for degree compatibility thing - but the DHL cost of £80 is too much ... I signed up for "international mail - signed for" hoping the letter don't get lost, anyone shared their experience?
