ECR with a Baby

Hi

I am really in a very bad position right now

I got married to a British citizen by birth on 27th October 2012. we applied for a uk spouse visa in 2013 june and it got rejected on financial grounds. my husband has not done anything since then to do something about getting me there. He stayed in India with me for all these years and finally left for Uk last year when I was expecting. I had a baby girl in sept 2016 and he or any of his family members have not even come see the baby yet and they keep on promising that they are doing something about the paper work . I know my daughter has the right for british passport and I have the documents for the same.

Q1) what alternative do i have apart from Spouse visa as I donot want to send my baby all alone
Q2) Whic is the best place to apply for her british passport India or UK?

Plz help.
