Hi, I am a master student and as I am a mature student I have a query about my son settlement application.

I wish to apply Settlement visa for my son through family route which is SET(F). I have just settled a few days ago and a case worker advised me to apply SET(F) for my son. However, I have looked at the SET(F) form, and found there is a section for sponsor, who is actually myself because I am a sole parent here (my husband is in our home country) I have to fill in details regarding the financial situation in the section including income, but I do not have any income as I am studying. My husband sends the money regularly for our living cost etc. I got a settlement visa through 10year residency recently.

I would be grateful if you could give an advice whether it would be successful if I apply the ILR through this route?

Has the child resided with you in the UK during the 10 years as well.

He has lived here for 10 years with me, but he has a 9 months gap in 2009 alongside my husband, so the caseworker who judged my ILR application recommended me to apply SET(F) for my son.

For Set (F), you will need to demonstrate sole parental relationship, which is slightly complex. Otherwise he will not succeed.

My husband works in our home country and I have been here with my son alone since he left UK in 2015. So if i submit my husband's employee certificate and income statement, then it can be a proval for sole parental status I guess. I went to Croydon premium centre for my ILR a few days ago, the caseworker who decided my ILR recommended that my husband attach the letter explaining he is content for my son to settle. The problem is I did not ask her about sponsor's financial section for SET(F), whether I can use my husband's money to support for my son as he is not a sponsor here.

Did the caseworker refused his ILR? If she thought that SET (F) was an option, why did he or she not allow you to vary.

Yes, that's right, his ILR was refused at the time I got the settlement visa, it was the day before yesterday and the caseworker told me to vary the application to SET(F) for my son, and she(caseworker) said I can apply SET(F) for him.
She said that my husband has to write a letter that he would happy with my son's settlement with the application form. However I could not ask about the financial section on the SET(F) form as I did not have any knowledge about the SET(F) from when I talked to her. I looked at the form when I returned home and found that I am a sponsor for my son as I have settled now and I have to fill my income and financial etc..
In this case, do you think it would be sucessful if I put my husband income on the form instead of mine as I have no income. Thank you for your reply in advance.
