EEA 3, Advice Needed

Can anyone please answer a few questions concerning EEA 3.

Me and my partner have been living together as unmarried couple for nearly 3 years, when I was on a student visa in the UK. I am an Indian National while my partner is an European National.

I am on IGS at the minute and working full time. My current visa is due to expire in Sep. 2008.

My partner has been successfully granted a Permanent Residence in the UK based on EEA 3. Now does that mean she has a Settled status in the UK If yes, can I apply for a residence in the UK using the FLR(M) Form?

Would you recommend to apply using EU Law for the Unmarried Partner Visa or the UK Law. Also, woul I need to wait till Sep. 2008 to apply as my visa expires end of Sep. 2008 or can I apply now. I have all the documental proof to prove my unmaried relationship.
