Spouse Visa - Cateogry A or Category B

Post by happykris » Sat Oct 13, 2018 5:11 pm

Hello

I am hoping someone could help me answer this, I am intending to bring my husband over. We are intending to submit next week. I have read so many people being refused because of some minor mistake. My situation is this:

I have been employed in the same company since 8th of December 2008. I currently earn around 39k due to a promotion that I received on the 18th of April. Prior this internal promotion, I earned around 29k.

I am intending to apply under category A as I was employed for close to 10 years.

On answering Appendix 2 of the VAF4A
I got confused when on question 3.12 - Has your sponsor been in employment with the same employer and earning the amount as detailed in 3.11 continuously for 6 months prior to the date of the application?
I cant say YES as most of april my job role was still the previous one, I put 39K in 3.11

So it directed me to 3.20 - Whats was your sponsor's total income (before tax) from salaried employment in the 12 months prior to the application? I am confused to what I should put in here? How do I calculate? My P60 is saying 29k?

It also says if your sponsor has or had more than one previous/other job you must provide full details for each job held at Part 5. You must also submit the specified evidence for each job detailed with your application.

Does this mean, that instead of using Category A, I simply go for Category B? I can provide all the payslips and the bank statements anyway.

I've read somewhere that ECO takes the taxable pay instead of the gross amount on some NHS payslips

Number Payslip Month Gross Amount Taxable Pay
1 October 24, 2017 2773.9 2515.93
2 November 24, 2017 2531.82 2296.36
3 December 24, 2017 2821.6 2559.19
4 January 24, 2018 2738.12 2483.47
5 February 24, 2018 2791.79 2532.15
6 March 24, 2018 2763.19 2506.21
7 April 24, 2018 2681.89 2432.47
8 May 24, 2018 3431.97 3112.8
9 June 24, 2018 3169.6 2874.83
10 July 25, 2018 3322.2 3013.24
11 August 24, 2018 3715.3 3369.79
12 September 24, 2018 3325.07 3325.07
TOTAL 36066.45 33021.51

How do I answer 3.20 = What was your sponsor's total income (before tax) from salaried employment in the 12 months prior to the application? Should I answer 36,066.45 or 33021.51?

Anyone? I know it sounds silly but its quite frightening to get a refusal due to wrong category?

Whatever your salary was in the 6 months prior to application date. If there was a raise in between the 6 months the employer's letter should mention it.

If you apply before 18th October you are relying on the 29k so put that down, if after that date then put the 39k.
