Spouse ILR eligibility combining Tier 1 and Settled person dependent route

Post by spongysponge » Sat Mar 02, 2019 8:12 am

My wife applied for the first dependent visa in 08/2014 as a Tier 1 Dependent. In 02/06, I got ILR and my wife applied for Dependent of the settled person leaving Tier 1 dependent route.

In 08/2019 my wife will complete 5 years for her ILR application. The question is, whether my wife is eligible for ILR as her length of stay criteria is met by the accumulation of Tier1 + ILR dependent route or not?

I appreciate your input.

Thank you.

She needs 5 years on spouse of settled person visa. She cannot combine tier 1 dependent time to make up 5 years for ILR.

Assuming your wife switched to a FLR(M) visa under the spouse category, her immigration clock was re-set to zero, putting her on a new 5 year route to settlement (ILR).

It's only possible to combine the two visa categories under 10 years long residence, when all legal stay in the UK qualifies

Edit: Beaten (this time) by a speedier CR001  .
