Spouse Visa Appeal - New Financial Info

Post by darbatross » Sun May 26, 2019 11:00 pm

Hi, hopefully someone on here can give me advice! I am planning to contact my local MP and try to find an immigration advisor, but I could use all the help I can get.
I will make this as brief as I can. I am American, my husband is Scottish, we were married last fall and I was on a Tier 4 student visa until January. I applied for a spouse visa on January 7th and just received a rejection with right to appeal yesterday. My application was rejected because we didn't meet the financial requirements, which we knew was a risk. My husband was between jobs for two months last winter, so we were just short of 18,600. However, we both started new jobs within a couple of weeks after submitting the online application. I included payslips and contracts with the paperwork/biometrics appointment (I waited until March for that reason).

So my question is this - if we appeal, can anyone tell me if our pay since January will be considered? We more than double the requirement between us, so I'm hoping so.

Thank you!

No, as the appeal will be considered purely on the evidence available to the Case Worker at the time of decision on the original application.
