ILR or FLRM

Post by abcz1020 » Fri Sep 20, 2019 4:47 pm

Hi All,

I got my ILR today on 10 year long residency basis (SETLR). My wife is was on Tier 2 General Dependent since last 5 years. She came 5 years back. My question is, Can I apply for her ILR now or do I have to apply for FLRM as I am getting mixed answers.

Thanks

Can I apply for her ILR now
No you cannot and if you try it will be refused. She doesn't qualify for ILR as PBS Dependent because you didn't get ILR based on PBS route but long residence route instead.
do I have to apply for FLRM
Yes, this is the only option she has and it will reset her 5 year ILR clock. She also needs to meet the English and financial requirements for FLR(M).
as I am getting mixed answers.
Really?? From where?? The rules have been crystal clear on this since April 2014 that a PBS Dependent has to switch to FLR(M) if the main PBS migrant gets ILR based on long residence, link below. So not a new change so not sure who is giving you conflicting information.

You were given the correct advice when you asked this question in February. Nothing has changed since then.
