Possible to refer case to GRO or any other action?

Post by Linchou » Thu Oct 31, 2019 2:57 am

Hello,

I am a naturalised British Citizen. I was married and divorced my first wife in India. I got married with my second wife also in India ( after divorce from my first wife in India) and applied for dependent visa for my second wife. I have submitted the divorce decree from Indian court and new marriage certificate with my second wife.

In case, for whatever reason, if my overseas court proceeding divorce is not recognised by UKVI then will my second marriage be considered as polygamous? Is yes, then will I need to take any action or provide documents proactively to avoid any legal issue.

Cheers
Lin

The requirement for a spouse visa is ONLY to provide evidence of the official court divorce decree and that the divorce is dated before your subsequent marriage.

Thanks, CR001. I have submitted the documents as you mentioned.

In case UKVI decides that the foreign divorce is not valid in the UK then will my case become polygamous marriage and it will be referred to GRO or only spouse visa will be rejected ?

Cheers
