Divorcing original sponsor and remarrying

Post by flubberduck » Sat Dec 21, 2019 9:54 pm

I arrived in the UK in 2016 but have experienced difficulties in my relationship which has since broken down. I am separated from my husband but not yet divorced, and my visa expires in 2 years. I have met someone since separating and we are wanting to get married.

I would like to know what action should I take in relation to my immigration status as I will be divorced from my original sponsor and I would like to apply for leave to remain with my new husband as the sponsor. What steps should I take? I would like to avoid going back to pakistan to start a new application so any advice would be greatly appreciated.

Also, should I wait until my current visa expires before making a new application?

Many thanks.

You can't apply for a spouse visa with a new partner from within the UK. Also as your sponsor, your husband is required to notify the Home Office that your relationship is no longer subsisting. Technically, your current visa became invalid once you separated.
