Unmarried partner visa - living together abroad valid?

Post by marblehouse » Mon Feb 03, 2020 11:22 am

Hello,

I'm looking into whether it will be an option for me (Australian, currently in the UK on a tier 2 visa) to at a later point apply for the unmarried partner visa to join my British partner in the UK under the requirement "you’ve been living together in a relationship for at least 2 years when you apply".

The complication is that we're thinking of moving to live in Australia for a year or so, before returning to the UK, with me then getting back via the partner visa. Would we qualify for this requirement if we had lived together for 2 years, but one of those years was in the UK and one was in Australia?

Any insight would be much appreciated!

Many thanks

There is no requirement that the 2 year period be in the UK, only that it it be a continuous period of living together. Be sure to collect items of correspondence addressed to you at the same address and any other evidence of joint commitments in preparation for the application. Additional details at the link below (slightly outdated I believe but still decent guidance).

I'm just a guy on the Internet who immigrated to the UK. My opinions are based on my experience and interpretation of the immigration rules and should not be considered legal or immigration advice; your mileage may vary.
