Spouse visa - new job offer

Post by shyamgorasia » Tue Mar 10, 2020 11:06 pm

Hello, I'll be sending in an application for a spouse visa this month around 20th March.

I was wondering if it would cause problems if I have got a new job offer, and I change jobs after I've made the spouse visa application?

Or would it be best to wait until the spouse visa is granted and wife receives her entry clearance?

Kind regards
Shyam

Thanks, was just curious becuase the new role I'm looking is a significantly higher wage. So just wanted to know if I could start the new job after I've submitted the spouse visa application and submit any new documents I.e. New employment contract, letter etc to Home Office somehow?

It takes up to 3 months for a spouse visa to get granted and is quite a long wait before you can apply for a new Higher paid role and the role may get filled by that time.

I welcome your advice.

Thanks.

Then wait until you receive your first month payslip from new employer then add 11 months of payslips from previous employer and apply under category B.

Shyam,

I presume you currently earn more than 18.6K and if you sent in the last 6 months payslips they would demonstrate that? When would this new job start, normally a month's notice is required and that is just wasted time. The reason I ask is, I can not see why you would need to wait until you have been in your new job for a month to apply, do it now if you qualify and give the HO your current financials, they have no clue you are moving jobs and will not find out unless your application fails for some reason and you are asked to send your financials in again, then simply write and say since the application was made you were offered a better job and changed employer, and here is 12 payslips. The HO cannot reasonably expect you to stay in a job, when you have been offered another higher paying one.

Many thanks for your reply.

I was just wondering. I haven't got the new job offer yet and yes my notice period is 1 month. I sent in an application and they wanted to interview me. They did say people apply with 3 month notices so shouldn't be an issue and they said they're happy to wait because I told them there were plans of redundancy in my company, and that the process may take up to 3 months.

I think I'll wait until the visa is granted and she is here, just incase it delays things/rejected. I'm more worried about the visa being granted/rejected rather than missing out on a job. Can always find a better job later.

I originally made a plan to submit everything on 20th March latest so hopefully my wife gets her visa by June (I've allowed 3 months). I want to stick with this and don't want to delay any longer than I have and/or give a reason for them to reject it.

Kind regards
Shyam

Right, so you have not even interviewed for the job! In that case apply on 20th and get the process going quickly. If you are possibly going to be made redundant, I would not delay, do it while you still have a job and 6 months pay slips. If you get made redundant while the application is being considered, the HO will not know and you can continue to look for work so when she does arrive you are hopefully employed.

Would I not need to send the new employer details if I do get redundant and find a new job? Or will they ask for them once they find out from current employer that I'm no longer there?

Although the income earned until/at the time of application matters but in case where the UKVI caseworker has to contact the employer (which happens most often but not always) then still the case can be refused/delayed if the sponsor is no longer working there. Safest option either to delay the new job offer or wait until the first month's payslip arrive. I disagree on that UKVI won't know about the change of job because UKVI on many occasions liaise with HMRC and there was a recent refusal where the sponsor's was employed but his employer was not paying tax.

Thanks. I'll just wait until visa is granted to avoid issues and delays.
