FLR M Income threshold effected bc of Furlough status

Post by Kartik11 » Fri Apr 10, 2020 11:20 pm

Hi,
My wife visa due to expire next month.
She is under Flrm 5 years route. I started working for a new company since 5 month and this month company put status as Furlough which would be 80‰ of salary. Because of this last month[6th month] Furlough scheme can't meet £18,600 threshold.

What will happen in this case?

Can she apply on Flrm 5 years extension visa?

If company will declare employer yearly salary more than £18600 but last month income is less due to Furlough status is that is acceptable for FLR M 5 years extension?

Unfortunately, a lot of people are exact same situation as you and there’s no official guidance on how to address these issues at the moment.

HO still expect applicants to meet the financial requirement at the date of the application and current crisis is certainly not your fault as it is beyond your control.

So far, Furlough will likely favour certain individuals especially those who are non salaried as per financial requirement definition.

They just need to add their gross pay received in the last 6 months divide it by 6 x 12 and the total will be used towards meeting the financial requirement.

For Salaried and you are furlough then it is difficult since they take the lowest in the period of 6 months to calculate gross annual salary so assuming if your income was low as a result of the furlough then it should not count against since you are on your meeting the requirement.

No one can accurately tell you except if HO addressed this issues otherwise if not addressed then you will need meet the requirement at the date of the application.

Another option is to ask your employer to pay 20% and explain to them the purpose of this.

Or

You can both combine your income to meet the financial requirement if you are also working?
My opinions should not be constituted as an immigration or legal advice.

Than use category B if have earned at least £18600 during the last 12 months. Also if you have 6 months old cash savings in excess of £16000 then you may cover the shortfall.

Hi,

Thanks for your reply.

I was discussing with my company regarding this issue which took bit longer. They said there is provision if company want they can add/top op 20% remaining salary which will make 100% of this month salary.

In this scenario I need clarification for below issues.

So far I am aware in payslip company write 80% Furlough payment is there any problem if its written Furlough payment in last month payslip?

As my 6 month salary will meet income requirements is it necessary to provide letter from company mentioned annual salary and current status of employment?

Do I need to mention this in covering letter?

Also as my wife application due next month are they accepting applications in this scenario or visa application is close temporary basis?

Thanks

Employer letter has always been mandatory ever since.

It is optional

Online application still can be made despite biometrics enrollment is temporarily suspended.
