Is Housing Association considered as public fund?

Dear all,
Thank you for providing such a supportive forum.
I am a British citizen, and I live in a one bedroom flat on an Assured Tenancy agreement. My landlord is a Housing Association. I need to apply for spouse visa for my wife. Is being a tenant of a housing association considered as being on the public fund? I read on the gov.uk web site Document Guidance – Public funds – v15.0 page 14, about it but could not quite understand it.

I really appreciate if you could advise me.

Sometimes it is a Public Fund and sometimes it is not; it depends if the council referred the tenant to the HA.

However you have British citizenship and can have Public Funds. It will be your spouse who will be subject to immigration control and will be NRPF (No Recourse to Public Funds). Therefore they cannot be a joint tenant on the tenancy agreement with you, the British citizen.

You can have a sole tenancy and your spouse can live there, as long as the HA have given permission for your spouse to live in their property.

You will also need a noc letter from the housing association allowing your wife to stay there which most often is not easier to get from housing association/housing authority.
