Spouse Visa for an Overstayer

Hi Everyone,

I and my girlfriend are in a situation. We met 1.5 years ago. We decided now that we want to stay together for the rest of our life. She came to the UK 5 years ago by Domestic Worker visa and it expired 4.5 years ago. She still does that job. She is a citizen of Philipines.

How complicated is she to get a visa?
I read about it a lot but I'm curious about your opinion.

We want to get together next spring in my property what I will buy in the next few weeks by a mortgage and we want to have a baby. She will leave her job before. I think about that we get married or civil partnership and apply her for a spouse visa. I'm not rich but my financial is more than enough for requirements (£40k gross by permanent contracted for a traditional British company) and I'm not a British citizen but I have Permanent Resident status by 5-year work in the UK as EEA citizen.

Can this work?
How much chance does she have of getting visa?

If she will be caught then straight can be deported with the ban of several years.

She cant apply spouse visa from UK and have to leave & apply from her native country.

Above will be effective if she apply from abroad as it wont sway any decision if any attempt will be made to apply for it from within the UK.
