I am currently on spouse visa and about 6 weeks ago my husband applied for universal credit for him and our child. I had to include my name in the application as the couple are required to make joint claims. In the application and subsequently via journal I made it clear that due to my immigration status I am not eligible for the UC but I was required to include my name so that my husband and our child can get their share of benefits. During the assessment period I received additional questionnaires from case Officer relating to my passport, BRP etc and I answered all correctly and made additional notes stating I am not eligible for UC. Then I received pdf letter stating my entitlement to UC has been declined and the journal was updated accordingly. But a week after when I looked at the payment statement (4-5 days before my husband received payment in his bank account) they have actually provided us full couple allowance of £594.04 instead of £409.89. My husband immediately notified authorities via journal and over the phone. In response, on the day before payment day one staff member updated journal stating she has had a look into our claim and it has been adjusted accordingly. But we eventually received full payment (full couple allowance). Tenancy agreement in our joint names which we sent to case offer upon their request and it appears that they have provided us full housing benefit as opposed to 50%. Please advise on my next course of action. Thanks in advance.
