Tier 2 ILR dependent family members Visa extension

Post by AbhiM » Sat Jan 30, 2021 10:23 pm

Hello All,

Hope you all are trying to keep your spirits up during COVID times.

I qualify for ILR in March'2021 under Long residence route for Tier 2 ICT Established Staff, as i came to UK in Mar 2011 and have been staying under Tier 2 ICT continuously since then.

I got married in 2014 and wife came to UK in Feb 2014 under Tier 2 ICT dependent, so she shall complete only 7 years when I apply for ILR(LR) in March. Our current Visas end on 31st March 2021. I would've applied for ILR by then, I wanted to know which Visa should she apply for continuing to stay in UK. Is there anyway that her residence clock doesnt reset or the only Visa category to apply is FLR(M) for her which I understand shall reset the clock?

Thanks in advance for any suggestions

She will have to switch to FLR(M) in this case. She will have to meet all the visa specific requirements including income, accommodation etc also.

You are correct her ILR clock will reset to zero for 5 year route, but she will be able to apply ILR via Long Residence in 2024 if she meets the residence requirements for LR. Otherwise she will have to wait till 2026 for ILR via the new 5 year route.
