I am a student here in London from India.I am living with my girlfriend together from last 3 months and she is British citizen .I have one child of 1 month old from her.We both are not sure that we will marry or not but we all live together.

Can I stay here in U.K. on the basis of child.I have seen the U.K. govt website and it has one category for the Right of Access to a child but then it has one clause that you should have entered in U.K. on marriage visa .I guess this category of Right of Access to a child is for those people who have entered in U.K. as spouse or an unmarried partner.If you have entered in U.K. on any other category like student visa and have child from British citizen then you do not fall in this category.

We both can marry but prefer not to do now.Can ANY ONE ADVISE ME ON THIS

how long u been living togther i think u mentioned 3 mounth and u have 1 mounth old baby. anyway if u are planling to marry then the situation will be different otherwise citizenship will be considered from mother so you baby is british citizen.

i am not sure but on the baisis of your and child mother's relation you can apply as a partner but sill i am not sure but people do apply without marriege but just a simple relation.
