So eu 38/2004 has finally been stuffed back into the faces of eu member states with a demand to get their act together - about time. For those that recall a year or two ago the grief I communicated to the board about the treatment meted out by embassy's in Moscow, all I can say is the following memo and commission report that followed hasnt come soon enough.

MEMO/08/778

Brussels, 10 December 2008

"The most serious problems of compliance have been identified in the following areas:

issue of entry visa for third country family members often very problematic (no specific facilities created for this category, visas are not issued quickly enough and additional documents, not foreseen in the Directive, are required to be submitted with the application for the entry visa ...)"

yes sorry to everyone reading the post, i labelled the thread wrongly.

my post relates to huge problems my wife and i had in moscow attempting to get a schengen visa and gaining free movement rightsunder directive 38/2004, i've written about this issue on many occasions and ran a petition a few years ago to raise the issue for more info run a search of my posts.

Anyway, the commission has conducted a review of the directive and the progress of implementation into eu member state law - needless to say eu state progress us poor and the report conclusions make for dismal reading
