Child birth in India

Hi everyone,

My wife is pregnant and she is planning to go to India for the child birth. She will be out of UK for about 6/7 months. Both of us received ILR in September 2007 (we hold an Indian passport) and we are planning to apply for British citizenship . I have a few queries around this.

If the child is born in UK, would the child receive British nationality automatically by birth?
If the child is born in India, how would it affect the child’s future application for British citizenship?
How will this affect my wife’s application for British citizenship if she is out of UK for 6/7 months (her date of entry into UK is July 2004)?

YES. The Child will become a British citizen otherwise by than descent because one the parents has been settled in the UK legally


If the child is born in India, how would it affect the child’s future application for British citizenship?

Your wife will be allowed out of the UK for a maximum period of 450 days in the 5 yrs period but no more than 90 days in the year before the application.
