Hello, I (female British Citizen in the UK) am attempting to apply for a spouse visa for my husband and wanted help on making sure I don't miss anything.
Our circumstances:
- Both me and my husband were divorced prior to getting married, we married in Pakistan.
- Previously I did not meet the financial requirement, however around 6 months ago I got a payrise bringing my salary up to £25,396.
- For the past 6 months the minimum my bank balance has been is £26,411, I believe this allows us to obtain the financial requirement by doing ((£26,411 - £16,000) / 2.5 = £4,164.40). £25,396 + £4,164.40 = £29,560.40.
- In June I transferred £12,000 from a shared bank account with my parents into my personal account (these were originally my savings earnt from my employment income but I kept them in a seperate shared account with my parents). My current bank balance is £45,000.
- We intend to live in my parents house, which is a 4 bed house with 2 bathrooms and the only occupants currently are my mum, dad and me (3 adults), my husband will be the 4th. At some point we will move out to flat but for the application this is the initial plan.
Documents checklist:
For my husband:
- Colour copies of all pages of his passport.
- TB test certificate.
- Pakistani divorce document (he was only married in Pakistan and divorced there too).
- A1 test certificate.
- Copy of the Pakistani ID card.
For me:
- Copy of bio data of my passport.
- Copy of all pages of my passport (to prove I'm a British Citizen?)
- Our marriage certificate, along with the English copy.
- Wedding photos.
- WhatsApp chats.
- My UK divorce final order document.
- 12 months payslips from my employer.
- Letter from my employer confirming the payslips / employment.
- 12 months bank statements covering payslips and cash savings.
- Last P60 document.
- Signed contract of employment.
- A letter declaring the source of cash saving being my employment income.
- A housing report for my parents place.
- A letter from my parents confirming they will accommadate us rent free.
Questions:
1. Do I need to explain the £12,000 I transferred to my account? Do I have to show all the historical transactions of that account to show I depositing my savings there?
2. When my husband shows his divorce certificate, does he need to have it translated to english?
3. I filled in a sample application and it asked me whether I earn the same amount above / below threshold continiously. I am confused what to answer in this question, because my base pay for the last 6 months reflects £25,396, however the first payslip has a pro rata payment on top. The third payslip also has a bonus on top. But the base pay is always the same. For this can I choose "paid the same amount below the threshold"? Or do I have to choose "not paid same amount below threshold?".
4. The reason I ask question 3 is because when I filled in the form, it's now asking me for 12 months payslips instead of 6 months, is this because I choose "not paid the same amount"?
5. When I am declaring source of cash funds, if I say it's from employment do they actually need to see statements of all the years where I earn the money or is it sufficient for them to just accept my declaration and only look at last 6 months payslips?
6. Am I missing any documents in my checklist?
I really appreciate any help you guys can give me, this is my first time doing a visa application and I don't want to make a mistake.
