Brief History:
I came to UK in December 2018 and was valid until August 2021. Then I have applied for my ILR application in August 2021. It got rejected in June 2022. I got to know it by my MP in April 2023 because my previous solicitor ran away. I applied again with my new solicitor in June 2023 and again they rejected my application in June 2024. After that Pre-Action Protocol (PAP) letter was submitted to home office in August 2024 to challenge the refusal decision. I lodged the application in September 2024 for permission to apply for Judicial Review at the Upper Tribunal. At this stage the respondent offered to withdraw my Judicial Review claim as they agreed to reconsider/review my case in October 2024. The respondent reconsidered the application and refused it again while giving me an in-country right to appeal in November 2024. I lodged this appeal to challenge this refusal decision. Now I am waiting for Tribunal to review my application.
I need to ask these questions.
1. If I withdraw my application what are the consequences?
2. What is the process of my application if I withdraw? Will I get any penalty for withdraw?
