need help and advise ... please

guys,

a very troubled friend came to me two nights ago with a problem I believe this forum regulars could very well help.
my friend has been living in with a partner for about three years now and had two children with her. he is on an ILR and not until recently he found out that his partner is here in the UK illegally, on an expired visit visa.
understandably he is so troubled by this.

please advise so I may relay to him what he should do, both for the sake of the kids and his partner.

also will the kids status of being a Brititish Citizen be affected by their moms illegal status?

and should the mom voluntarily or involuntarily goes back to her home country, can he ban her taking the children with her? and how?

please share some advise for a very troubled man.

alphax48, can you please say what country she is from? That might enable us to say what she might do. It could make quite a difference if, and these are just examples, she is from say USA or Zimbabwe!

Can you also post about what the couple are doing about benefits, such as Child Benefit and Tax Credits?

thanks for the reply.
they're both from the philippines and just now i've called him and he said he hasn't claimed child benefit nor tax credit, 'twas only this month that he did file for child benefit.
all along he thought that his partner was claiming all this.

he said that getting married now is out of the equation. his partner was/is married in the Philippines and to get her marriage annulled would take sometime.
