Marriage visa

Hi

I am marrying a Croatian man in a few weeks and will be marrying abroad, but I need help as we previously applied for a fiance visa for the UK a couple of years ago which was successful and he came to live in the UK with me, however we broke up just before we were due to get married and he stayed in the UK and overstayed his visa (only by about 1 month), he was stopped by the police for driving without insurance and was removed from the UK at the end of 2007. We always remained in contact and recently re-established our relationship but due to his past breeches of immigration law and a driving offence will this prevent him from being granted a spousal visa?

I am not sure, he was charged but then he was removed from the uk within 24 hours so he might have been convicted in his absense.
