Elderly dependant visa

Post by rajsun » Tue Feb 09, 2010 1:24 am

I am a British Citizen , naturalized in may 2009. I wanted to bring my parnts to UK as my dependants.

My father is 68 yrs old and mother 58 yrs.
They are financially depend on me and living in my property in India. They dont have a job .Both my sisters live in Dubai.
My youngest child is in India with my parents. He is only 2 yrs and so close to my parents. I cant bring him back to UK without my parents, because of the fear to give him a psychological shock[/list].

Do you think they can apply for dependant visa? What all documents I need to submit?

If they dont qualify what should be my next option?

Please help.

Read Older Dependent Relatives.

Alternatively, invite them over to UK on 6-month family visit visa a couple of times and then apply for a 2/5/10 years long-term family visit visa. This way they will be able to spend 6 months (in 12) in the UK.

Not easy to get one, so I hope you have submitted adequate documentary evidence to prove that all qualifying criteria are being met.

All the best.

We'll need to know the exact wording on the rejection before anyone can offer a suggestion.

Ecos refusal letter

I have refused your visa application on this occasion because I am not satisfied with the probabilities, that you meet all of the requirements of para 317 of immigration rules. This decision was made on the merits of this application. However, if you have a previous application and immigration history, this may have been considered.

You say you receive monthly income from your sponsor. However you haven’t sent me any evidence to show this. A statement showed you have transferred some money through one cousin. No evidence has been provided to verify that this was the case. No evidence of receipt from you cousin and no evidence of receipt of these funds by you. Your sponsor’s bank account shows no other money transfers. Also the presence of cousin indicates that you have relatives in India.

Can I appeal ?

I sent my bank statements showing the money transferal via cheque. Last year I send the money 4 times to my mothers account. My father, first applicant hasn’t got any bank accounts. So I had to send money to my mother’s bank account. Do I need to provide any documents to prove that my father hasn’t got any account?

I send money through my cousin once. But he lives in another state and not willing to support my parents. He said he can give me a statement telling he given money to my parents. The money transferred a month later after we given the money, because of the less conversion value .and transferred from his wife’s account. My mother’s bank account shows that she received the money. What other documents we can provide for this?

I believe you should be able to appeal, it should say some where on the refusal letter whether you can appeal and how so.

Get a letter from your cousin confirming money tranfer together with the evidence of how your cousin send the money over to your mother.
What sort of evidence can you get to proof that your father hasn't got a bank account?
You or your father writes a letter explaining why your father hasn't got a bank account and therefore you send the money to your mother who has got an account. Also explain (with some evidence if you can) why your cousin cannot support your parents.

Good luck

Thank you very much for your reply. It is written in the refusal letter that I can appeal. Can you explain me the process please.

I am planning to submit the appeal in UK. Do we need to go through a solicitor or immigration consultant. In what way I should present my arguments and statements.

Please help.

You don't have to go through a solicitor. you can do it your self if you feel confident. However, as it is one of the difficult visa to obtain, etc I would get legal advise.
