overstayed and want to be married

hi all im british but my partner is from burundi he came over with his mother in 2001 when he was 16 and she applied for aslyum with him as the dependent however she decided to return to a third country to get married vouluntarily before the home office decision was made leaving my partner to fend for himself, that was when we met fell in love. he didnt knw the HO decision to fail the aslyum case as he had moved from the address they had. we now have 2 children below 5 yrs and wanted to marry, we saw a solicitor as he didnt knw that the application was failed. we have appealed in his own right but dnt knw wheather he will be granted to stay due to the ties he has, do u think its possible for us to marry in the church of england and will this help his application thank you

If the Asylum Appeal is rejected then you still have the option of a spouse visa

If he is willing to return to his country , then a spouse visa could be a good option for him to get a legal stay in the country (provided you are both over the age of 21 years old , i see he is) . He should get the visa aslong as he has no criminal record in the UK .

hi rattlesnake thank u for ur feedback we have thought abt the option of going back however he was born in burundi and lived in uganda with his mum for the earlier part of his life most of what he can recall then when things didnt work out in ug they came here so we dnt knw what to do and how if he is to go to burundi .....

all was settled and he was granted ilr within 2months and last year he became a citizen we got married finally. i want to thank all members for the continued support and words of wisdom helping us settle
