SPOUSE VISA APPLICATION HELP PLEASE

Post by Hish87 » Wed Sep 22, 2010 9:19 pm

Hi guys, new to the forums and ive been reading for nearly two days straight and cant seem to find what im looking for (after hours of using the search function as well)

My situation:

I am currently employed on a full-time basis, previously part-time, however im still waiting for an official contract of employment. I have collected at least 6 months worth of payslips and the same amount of bank statements.
I currently am living with my parents, which i help with maintenance costs and all but dont officially pay rent as such. However im more than prepared to find a place of my own.

Recently got married this summer back home in Morocco (both of us aged 23) after a years engagement. Now im back, im struggling to find answers and understand a number of questions (hence opening a new thread, sorry mods!)

1) With regards to accomodation, would it be sufficient to provide say a rent book with only a months worth of rent? Or would i need say 3 months worth of rent history?

2) Regarding my contract of employment, at this moment in time the company i work for are having them redrafted by a H.R company, so, instead, to be able to apply before the 29/11/10 and avoid the english test deadline, they are willing to provide me a written statement stating when i started working for the company, number of hours i do per week all verified by my manager, area manager and current director of our franchised store? Or would the application be useless without a contract full-stop!!?

3) With the new english test, due to be implemented after 29/11/10, if an applicaiton is submitted before this date, would the applicant have to sit the test or not? (according to a friends brother who is an immigration solicitor)

This questions is of great importantance to me as she still has to sit the test then I can delay the applicaiton to gather more evidence and collect more funds and have a stronger case.

4) With regards to the test, where would someone from Morocco sit the test??? Also there are a number of test types listed, what test would she need to sit, or what would they make her sit in Morocco?

I hope you guys can help because I'm losing alot of sleep over all of this : (

Many thanks in advance

Hish!

Hello Hish. My husband is Moroccan.
You don't need to submit a contract of employment. The bank statements and payslips will be fine and the letter from your employer will add strength to the application but isn't mandatory.
You can if you choose (and there's sufficient room) stay with your parents.
They would need to submit a copy of their mortgage agreement, or a copy of the house deeds if no mortgage applies, or if rented, a letter from the landlord agreeing to your wife living there. Although you don't have to pay rent (as far as the application is concerned), it would be better to state that you will be contributing at least a nominal weekly amount towards food and household expenses.
If you decide to rent your own property, a copy of the rental agreement will be fine. You don't have to rent for a period of time before the visa application.
If your wife applies before the new English test regulation is introduced then she would be subject to the existing rules, without the need for the test.
However, if you have everything in place, I would apply sooner, rather than later. The fees are due to increase shortly.
Rabat aren't interviewing at present. The application is decided on evidence submitted.
I'm assuming that you're OK with proving you will be able to support yourselves financially. You need to have a minimum of £102.95 remaining a week after rent, council tax (if applicable) and any loan/credit repayments.

Hello Casa

Thankyou so much for your response : )

A couple of other things i need to clear up

- Would i need a copy of my P60 from last year (april 09- april 10) when submitting the application

- The english exam, is there a specific test she must sit, where would the test be held and at what point will she take the test?

- and the price increase... has the price been finalised or is there a page stating the increase?

Many thanks

Hish

The P60 isn't mandatory, so don't hold up your application if for it, as you'll be submitting bank statements and pay slips. What you're earning currently is more important than what you've earned in the previous tax year.
Let me check on the test.
Visa fee will rise to £750 on the 1st October.

that would great casa..... are you 100% sure about the p60, because alot of people on here quote that, as well as their contracts of employment.... hmm im pretty sure a leter from my bosses should prove im working and all that

i guess its more about having enough money in your account to support to a suitable sponsor!

is there someone i can email from Rabat to get a bit more info? Or are they in no mood to help anyone!?

You won't get a response for a general question from Rabat. They'll just refer you to the website. If you have a P60 then by all means include it, but with proof of earnings in the form of pay slips and bank statements + letter from your employer, they won't refuse due to no P60.
The ECO will be more concerned about seeing regular income from employment than savings..although everything helps.
I've just arrive home from the office, so will have a trawl to see if I can give you a link to the English test. If you apply before the end of November your wife won't need it.

Hish, try this for test information:
Pearson Language Tests (Head Office)
80 Strand
London WC2R 0RL
email: pltsupport@pearson.com
Tel: 0845 543 0243

According to the PDF of information on the UKBA website these are the providers of the English test in Europe, Middle East and Africa, which I assume should cover Morocco in North Africa. They do list an email for these countries as
pte-acustomersupportmea@pearson.com
but it may be best to try the UK Head Office first for more info.
Let me know if you get the answer you need.
