Hello,
I have a bit of a situation so I will explain what has been going on in my life past few years in order to clear things up a bit to get the best answer.
I was born in Zagreb, Croatia. I have lived in the USA for the past 11 years. I have am a US citizen and have a US passport. My husband is a UK citizen.
We have met about 6 years back and have had a long distance relationship. We have gotten married in USA in summer of 2008, and we have gone through the visa application processes (very lenghty!).
He has received his conditional Permanent Resident Card there (has it for two years, gets a social security number, is allowed to work, and after two years if we are still married we would proceed on with applications to receive a proper Permanent Citizen card for him).
At the end of this summer we have decided to move back to Croatia, we really wanted out of USA in general due to lack of work.
We have been in Croatia with my family as visitors for about two months.
Now we are visiting his family in UK and I can stay for three months on a visa waiver program.
I do not have Croatian documents, I have changed my name and been written into the book of Married in Croatia. I can (and depending on situation will) get a Croatian ID card which can take up to a month due to their check up process. And if I do that I will take out a Croatian passport which I am entitled to due to being born there.
Now what I am looking to do is to move to UK with him. We are staying currently staying with his mother. He has just found a job that will start next week. I can stay in the UK til the end of January 2011 on the visa waiver program with my US passport.
What is the best way to go about me staying in the UK with him? Do i HAVE to go back to Croatia and apply there? Is it better to use my US passport and documents or a Croatian passport (if I get it)??

You won't be able to apply for a Spouse settlement visa from within the UK. Probably best to apply with your US passport. Form VAF4a. You will have to show that you will be able to support yourselves financially and have adequate accommodation immediately available on your arrival into the UK on your spouse visa.

I cannot go back to the USA and wait for a visa there. Can I apply from Croatia with a US passport?

If you're legally resident in Croatia, then yes you can.
