Help With Fiance Visa!!!

Post by enzopert » Thu Jan 27, 2011 4:14 am

Hey everyone
I hope someone here can help me, as I am very confused on what I should really do!!!
I am an Iranian national currently in Iran, I have lived in UK for 8 years and returned here about 3 months ago, to extend my student visa, but unfortunately my app got refused, on lack of some documents, I got in touch with my college and stuff and they are asking me to pay £1500 for a new cas, i complained about this and how bad college treat their students to embassy in abudhabi, to which the officer in abudhabi decided to forward my email and his reply which was totally useless to college director, after this the college are accusing me of lying and refusing to sponsor me all together and they said they will not even give any refund!!!
I look around on some other colleges but none are taking a new students hence my only chance is to wait till next intake in June and pay another £3000 plus!
My girlfriend of almost 2 years who is a UK citizen suggested maybe i should consider applying as a fiancé, her idea is good but there are a few sticky points i like your help with:
1- She is currently studying, it’s her last year of Uni, and she has a part time job, how much would this affect the application
2- I can have someone else co sponsor me for the initial 6 months while i can’t work, would that be any use.
3- Can they offer to accommodate me as well, thou i have my own flat there but the lease is expiring soon.
4- As i am half way through my course i can not show that i have a uni degree or anything, but i have had many part time jobs, should i add my CV as to support my job prospects
5- I have got a part time job here, thou the pay is not great, should I add that too
6- From the bank statements point of view, i can provide them bank letter up to £6000, is that enough?
7- Would my refusal for the student visa have any bearing on this app?

As i cannot stay in Iran for long due to some national service issue, I am even considering to apply for a short English course for a few weeks, and once in UK be able to arrange for everything else.
Do you think embassy would grant me such visa? Based on my history!

Do you actually intend to marry? You seem confused about the 6 month period. You don't have to wait 6 months to marry...you have to marry within 6 months of the visa being issued. You would apply for FLR(M) - Further Leave to Remain after the wedding. Once this has been granted you are able to legally work. You will also have to pass the new A1 English test before you apply for FLR as a Spouse. Bear in mind that on a Fiance visa you won't be able to continue with your part-time job until your FLR visa has been approved once you're married. Your girlfriend may struggle to show that she can support you financially if she is only working part-time although your savings would be taken into consideration. If you enter under a short term study visa, you will have to apply for a Certificate of Approval from the Home Office for permission to marry in the UK.
You're both over 21?

Hey thanks for the reply.
Yes of course we intend to marry, I know we do not have to wait for the whole 6 months, I just assume when they look at your bank accounts and stuff they would say it needs to cover you for at least 6 months! once i am there we shall register asap. Im 26 and she be 21 in a month time. Although i am hoping if she shows, she has got some savings and i show some, then that should be ok? with the english test i can provide a certificate for that, an english exam i took back in UK! another question is, do we need to have a wedding ceremony? or registration be enough, as my fiancee doesnt want to have the ceremony till next year, some where exotic!

with regards to short term visa, from what i read on UKBA website they most probably refuse me if i apply of CoA, plus i doubt they would grant me short term study visa cos they need paper work from every course or institution i studies in uk, which could take ages to gather! plus i am half way through another course, guess it be hard to justify to them the sudden change!

Unless you have a Batchelors degree taught in English, you'll need to take the new A1 English test with one of the approved providers on the UKBA list.
I'm unsure what you mean about 6 months of bank statements as you won't be able to work legally on your fiance visa until after you've been granted FLR(M) following the wedding.
You can marry at a Registry office (if this is what you're referring to). It doesn't have to be a religious ceremony.
You can only apply after your girlfriend reaches the age of 21.

Hey thanks for the reply
The English test is no issue as i already have certificate, and its B1! And its from an approved provider. I just need to get it updated!
What i meant by 6 months is, that i need to show them i can maintain myself for 6 months, ie with the savings i have and my fiancée has at the moment and my accommodation arrangement once i get there! I am looking to ask a friend to co sponsor me while i am on Fiance visa.
I checked with UKBA website with regards to age, we can apply as long as it is within 2 months of the 21st birthday and they would grant me the visa from the day she turns 21. I hope i am right.

I just dont wanna waste my time and effort and money if this dont work, cos applying again would be very difficult, cos if this app gets refused it would be second refusal in a few months! and to be honest being away from her has been very difficult and i dont wanna be away from her any more than this! thanks

Can you provide a link where you picked that up from? I'm not aware of that allowance.

Ok - but what it says is that he has discretion to do it - not that he will.

More certain to wait until after the 21st birthday.

Dear Casa

My main issue now, is that how to convince ukba that we have enough funds available. she be 21 in 32days time, and she has a part time job plus she is her last year of uni, she has about 3k of savings and i can show about 6k here, my biggest issue now is sorting out a co sponsor to support me between the time i get there and the time we get married, hopefully by then CoA would be gone so less hassle to deal with!!!
the only issue is most of my friends have rented accommodation (I do have my own flat there but the lease is running out end of Feb, if i renew the lease for 6 months would that be useful thou i have to pay rent while the app is going through), do they need to have the permission of the land lord if they wanna invite guests a have to show proof, or just a lease confirmation be enough? can i have more than one person co sponsor me? how much money do they need to show?

Thank you
