spouse visa

Post by mangesh007 » Thu Sep 01, 2011 11:51 pm

hi everyone,

i am a indian citizen, currently living with my mother(she is holding a indefinite visa) and my wife(she is british indian) in the united kingdom.

we all leave in our own house(mortgaged).

my problem is i recently applied for my spouse visa and after applying i realised that my wife has to be 21 years or over(she is 18years of age) for me to get the leave to remain.

i know my case will be rejected and will get an appeal as well..

my question is: am i able to appeal on grounds of human rights as i dont have a family back home and dont have house to live as well.

please help.

Apply for FLR(M) shorty before your leave expires to preserve the right of appeal.

How long have you been married? ECHR 8 family life applications are assessed on your proportional human rights and a short relationship followed by marriage may not cut the mustard. Seek competent legal advice on your options.
