overstay...dont know what to do

overstay...dont know what to do

Hi, i am a british citizen and married my wife from pakistan. she came to the uk in june 2009 on a 2 year spouse visa...now that 2 year visa has expired and she is an overstayer...what is her status what shoule she do. i want to either apply for an extention for 2 year or apply for indefinate leave...however as of yet she has not done any english course that are need nor dose she have and documents such as bills or bank account...we have a son who was born june 2010 and expecting another in december...this is main reason she has not yet done english test...we live with my brother hence do bills ect...what should i do...many thanks

She should pass her LIFE IN THE UK test and apply for ILR as soon as possible

However, why did she not make a FLR(M) application before her leave had expired?

we did not have many of the docs that she required...and as she was pregnant she struggled to attend the course for english...and we were trying move out so docs were all over the place...2 years flys past when your trying to start a family, work 50 odd hours a week and try to tprove your living as a couple...even though u are. she dosnt have a bank account (as innitially she did not require 1, wee live with my brother so he pays all the bills) and when we went to make one they refuse as she had less than 6 months left on her visa...so were stuck there...so she cant have bills in her name...were happily married and living together...but getting this proof is harder than it shoud be...should we tell home office that she is a over stayer...im worried they may sent her back...i have booked an appointment with a solicitor to give me soem advise...its taken me this long do do some thing because in april i was in process of buying an house so thought i will do it all once i mouve out...but that fell through...now im process buying another house...but will stay at my brother until visa is sorted...seems best way to do it...omg this is so complicated...
