UK - Settelement Visa for Parrent?

Hi Fellas,

i have 3 basic questions. Any help is much apreciated.

I am an EU natioanl (german) married to a UK national,setteled and working in UK for over 5 yrs. I want to get my mother over to permanently stay with me. However my mum is a not a EU national (US citizen) but being a non-visa national she also doesnt require a Visa to enter UK and is currently staying with me as a 'Visitor' for last 2 months.

I read on UKBA website that i can get her over using EU treaty rights filling form VAF5A but no where it mentions How/Where to apply if the applicant is already persent in UK (albeit just as Visitor in this case). So the questio #1:

1. Will my mother need to go back to US to apply for settelemnet visa OR can she apply from within UK (as she is legally here)?

2. I ve also read somewhere that there is an age limit of 65 yrs for dependant parrents but my mum is a few yrs short of that. Can she still qualify?

3. What is the difference between VAF5A and VAF4A. Is VAF4A better, as it directly gets you ILR, where as the VAF5A only gets you 5 yrs EEA Family permit after which you will become eligible for ILR. If so, in my case can i apply for VAF4A at all?
