COURT HEARING NERVOUS

Post by huni » Tue Mar 20, 2012 4:36 pm

Hi I Live in the U.K and I applied for my uncle (Family Visa) who lives in Pakistan to come and visit me,but it was refused and was taken into appeal.
I have a court hearing in a few days time and i am very nervous .
This is what it said on the refusal letter...what is a court hearing like and how long does it last or what questions am i likely to be asked thanks.

Also will they decided the case on the circumstances which was then or now ? Because I have moved house and stopped working but my partner is working full-time and earns 15k a year and his wage slips were included in the documents .

Also My uncle submitted a letter from employer and declared he has a mother who rely on him financially in Pakistan. Also his bank statement but it had 100 pound entered once then 1000 pounds straight after.I said in the documents i sent him this money for travel expenses etc.

refused because

The Visa Office refused to issue a Family Visit to the U.K to my uncle on the following grounds.
1. No Proof of Pay Slips
2. A Large Deposit of Rs 150000 = £1087
3. Insufficient Economic and Social Ties to Pakistan

But they wrote

On your application form you have stated that your sponsor will help pay for your trip and that he will maintain and accommodate you.You have submitted your sponsors salary slips and bank statements and I accept that your sponsor has the ability to maintain and accommodate you. However,in assessing your application I need to be satisfied with your personal and financial circumstances in Pakistan. You have not demonstrated that you have a sufficient strong economic and social tie to Pakistan because you have failed to substantiate your employment income. You do not have any family ties in Pakistan.Therefor I consider that there is little to encourage you to leave U.K on completion of a visit.I am therefor not satisfied that you are a genuine visitor.

Thankyou

Its the usual claptrap reasons for refusal.Just go to hearing and be absolutely honest in what you say in that your uncle is coming for a short visit for a genuine reason to see you and your family.Explain the reasons for deposits in bank. Try and provide evidence that he will return for his job, family, land etc.

You will win the appeal because the adjudicator are more sympathetic and understanding than an ECO who just looks for any reasons to refuse .

If you want to know what goes on a t a hearing, visit he court where your hearing and look and listen as to what goes on at such hearings. It is very informal and don't worry to much....just be honest with facts.
