They were not being particularly generous or nice. There is a law and they are following it.

I am sure UK immigration would do the same. And Irish immigration for that matter. The same requirements are written into UK and Irish law.

the british embassy in Damascus is closed...so i had to go to Jordan to apply from there...i'm in Jordan now..i applied yesterday at the Visa center, today i went there and a letter from the embassy said that i have to supply documents:
-my home address in the netherland ( although i live in Syria with my husban )
- my work contract in the netherlands
- my bank statment in the netherland


the problem is that i have been living with my husband now for 1 year in syria, so my bank statment is in syria , same as my address, ..and i'm not working in Syria.

so i think they didn't get the idea that i'm living with my husband in Syria,

now do u think that my husband can apply for the family permit if we r living togather outside the EU and i haven't gone to the uk yet,,,i intend to go there next month ( with my husband ) to start working , and i have a work contract which proves that.....i'm going tomorrow to the embassy to try to make myself clear if i can.........i'm having a bad luck here...

i'm working on tHe documents, and when i have them all , i'll take them to the british embassy, maybe next week, thanks for asking

Hi Sham,

You do not need those documents at all to go over to the UK with your husband.
Write a support letter to the embassy with references to case laws relevant ot your scenerio and application should be treated under the EU rules.
*The EU Directive on free movement rights, the right to move for a third country family member of a Union citizen derives from the family relationship alone, the member states requirement to present any supporting documents beyond those establishing the identity and family link would be an obstacle to free movement (with reference to case C-157/03 Commission V Spain).
*On arrival to the UK, your husband the application for a resident permit should not be hindered by ''previous residence in another EU state test''(ECJ case of Jia (Case C-1/05).
Pushand let them you have a right to preserve.

hey guys, i've just got the visa today, i went with my husband to the embassy with all the documents that prove that i used to live in the Netherlands before getting married, he went alone inside the embassy with these documents, as we were told at the entrance....like when he entered the embassy ( 3 weeks ago ) he didn't do an interciew, instead there was a local employee who collected the documents from him to take them to an inner room, today they did the same thing after he gave them all the documents ( bills, graduation certificate, formal letters....and other documents that prove i was ling in the netherlands ), they took them inside and half an hour they told him to get back afternoon ( same day ) to collect the visa.......we''ll lback to go to the UK during the next month.....
