student visa switch to spouse visa?

Hi there,

asking on behalf of a friend. My friend came last year on student visa to study. He got married July 2023 and his student visa will expire on July 2024. He wishes to switch to spouse visa, is this possible and which form is it? Also he has not been in country for more than 2 years so is unable to satisfy the 2 year address history. His spouse is a British national.

Form FLR M.

There is no requirement to provide 2 years address history. Unsure why you belive there is.

Hi,

So after checking with my friend, they have already put an application in for family route and have input incorrect address details of where they were staying.

Subsequently they have tried to cancel and get fees back because they have not have their biometric appointment yet.

They are looking to resubmit a fresh application. However on the currently submitted application - on document checklist it is listed as a requirement joint correspondence from both applicants and that's where that assumption came from.

Also to cancel and refund, there doesn't appear to be any form apart from request documents back - is that the correct one? Is there a requirement to wait for the refund/cancellation to come through before submitting a new application?

It's a generic form hence why they saw the requirements, it does not apply to them no issue.

The error can be addressed by providing a cover letter indicating the correct address, take along to biometrics appointment for upload. No need to cancel application because of this.

Oh dear - I think they have already submitted the online return documents form and received refund of biometric appointment. However they are still able to log in online and continue uploading documents so can they continue that application? How does one check the status of a cancellation? Is there an email?

refund not received yet - only biometric appointment but ok will proceed - thank you so much

So after lots of blunders my friend has submitted application for spouse visa, switching from student.

They have been married since July and living together since that time.

They have provided:

Id documents
English test
Letter from employer
Contract of employment
Payslips
Wage slips
Letter from employer explaining underpayment of wages
Tenancy in both their names since July
Marriage certificates
Signed consent forms

The form keeps asking for joint correspondence but they do not have any of that since they are only together since July and also the student has only been in the country for 1 year.

Is there anything else that's need providing like evidence of relationship etc?

Is this all documents required
