SPOUSE VISA EXTENSION QUERY

I am a British Citizen, and my wife received a Spouse visa in October 2022. Her visa BRP expires in December 2024, but when I checked online, her visa status and right to work are valid until July 2025. We also have a son who is a British citizen. Here are my queries:

1. When is the earliest she can apply for an extension? Can she apply based on the online status expiry date, allowing her to travel from December 2024 till July 2025 even if her BRP is expired?
2. English requirement: When she first applied for her spouse visa from India, she obtained a certificate from Ecctis confirming “The level of English language for the above degree course is considered to meet the requirements of CEFR level C1”. Does she still need to meet the English language requirement, or can we resubmit this Certificate again.?
3. Financial requirement for spouse extension.
4. Type of application.
5. Full list of required documents if you have.
6. Last question related to ILR (When I checked UKVI website Check your route to indefinite leave to remain it states - check the letter you got from the Home Office when your ‘leave to remain’ was last approved. This letter I lost not sure what was written on that letter.). Is there any other way to find this information.? if she can apply for 2 year or 5-year route for ILR.?

1. All brps expire in December 2024. The approval email/letter will state visa duration, usual 2 years and 9 months if applied for outside the uk.

2. Fine to reuse.

3. Same as before £18,600pa etc.

4. FLR M is the form.

5. The checklist and Appendix fm guide will tell you. English, financial, 2 years evidence in both names of cohabitation.

6. There is no 2 year route to ilr for spouse visa holder anymore, that ceased in july 2012. She needs 5 years for ilr on a spouse visa.

I have a question about the evidence required for proving 2 years of cohabitation in both our names.

1. Will a 2-year bank statement or a letter from the bank stating our names and confirming that we have had an account with them for more than 2 years suffice as evidence?
2. Do we also need to show council tax bills or is the bank statement or letter enough?
3. The utility bills are in my name only, and my wife's name is not included. Do I need to send this as well with the application

List of documents for FLR M -For spouse Extension visa
2 years of cohabitation documents- Bank (Joint account with husband and wife's names on it) statement for the last 2 years, 2 Phone bills (One Husband's name and one for wife's name they are 2 different bills with individual names on it with the same address, Wi-Fi (Husband name only ), Land registry copy of register of title ( Husband name only.)
- 6 months’ payslips from my employer, certified by my employer
- 6 months of bank statements, certified by the bank
- A letter from my employer confirming all the required details and that the payslips are genuine
- My British Passport (scan of every page) as proof of my immigration status
- Evidence of monthly housing costs for accommodation in the UK ( All Mortgage paid off shall I send mortgage closed letter from the bank I received ?)
- My wife's BRP card
- My wife's passport
- English requirement CEFR – Level1 which I used previously for a spouse visa.
- A cover letter from my husband explaining why he cannot establish a private life outside the UK. (Do I need this letter .?)
- Baby birth certificate
- Baby passport
- Marriage certificate
Can you pls confirm if the above list of documents is sufficient for extending my spouse visa, or if I need to add or remove any documents. ?Also, I have linked my BRP to my UKVI account, and it shows a partner visa valid until July 2024. Can I travel in and out of the UK by showing my online status using the UKVI account (For showing the visa validity) and a valid passport? I would highly appreciate your input and suggestions. Thank you for your response. I apologize for not mentioning earlier that I am not applying at the moment. I am currently preparing the necessary documents for when I apply before my wife's visa expires on June 30, 20225. I plan to submit the application on either the 1st of June or mid-June 2025.

Could you please review the list of documents I provided and let me know if they are sufficient? If there are any unnecessary documents, please advise on what to remove, and if there are any additional documents required, please let me know.

Surely you must have from government agencies as well. Like NHS, P60's, local councils etc. At the end of the day, you can only use what you have. If not enough, they'll let you know. That might just cause a bit of delay.
