and I will not even get student visa because i am already on 7 years + on student visa

Which visa do you have at the moment? if you can extend this visa any how first try this? don't jump if you have a option. If you don't have a choice then something is better than nothing, you have to apply this, whatever happened? nowadays people saying flr application deciding within the 3 months time. Even if your application is refused you have a right of appeal might be it cover 7 months, you never now. Good luck.

Some say go for student and same you will get refusal and then you appeal and you finish your time in 7 to 8 months

but i think now a days student appeal they are finalize so fast that withing 4 or 5 months they even short out the appeal and decision all together

@thamiskumar I think apply for student visa is best for you because human right application is very tough nowadays, this is my only thought. For the best you need to take a leagal advise from good solicitor. You might go PhD and other masters course. Even in a phd its too late, you need a approval from university. Ya phd is the best option. I think if you go phd you don't have a time bar. Take a advise from good solicitor please, your time is too short, act as soon as possible. Once you have a valid visa, if you try there are so many routes but when visa finished every door is closed, and you are overstayer, doesn't matter how long you lived in uk before, it doesn't help, thats I, we people suffering here. In my case I been here in uk 16 years, still fighting for status because I didnt' act properly when I got a visa. Good luck.

I think based on the facts you have shared so far, making an application for a private life in the UK appears to be the best option.
You barely have time to find a course or a job that can sponsor your tier 4 or tier 2 application respectively in addition to other conditions such as maintenance etc..
Your FLR FP will most probably be rejected as your human rights case does not appear the strongest. You should however be able gather the time needed to complete your 10 years lawful stay when waiting for appeal to be heard.
However, whatever you do try to submit your application before your current PSW visa expire.
By the way you can't extend Post Study Worker visa(PSW) as it was only issued for you to look for job after your graduate or postgraduate course and in any case it has since been phased out with exception of people just finishing a Ph.D course. In addition, applying for FLR will not stop you from being granted Indefinite Leave to remain under the ten years lawful stay. You can read the policy on the Home Office website.
As others have advised you may be better off with making the application with the help of a good immigration solicitor.

I've been following everyone's progress with interest, I hope everyone is well and holding on to hope we will all be free one day soon. I guess I have probably been waiting the longest based on what i've read on here.

A summary of my situation..

I came to the UK at 15 all my family here have ILR but for some reason mine was not processed because I got to 18 before a decision so i'm considered an over-stayer. I applied before having children and paid £1500 only to then be told a year after the lawyer passed away nothing came of it. I now have children who both have British passports and their father is in the armed forces. We reapplied in 2010 at the time my daughter was being evaluated speech and language disability she was 2.5yrs we submitted everything also my partner was based overseas but we had a joint account and he came home every 3 months because we couldn't travel to be with him. October 2010 they refused my application stating I could go back to my country and get entry clearance this was impossible because my family are here and USA so we had nowhere to be and my partner was also away preparing to be deployed to Afghanistan.

I ask my solicitor to submit a reconsideration which he did in Jan 2011 after all these year I sort of forgot about it, I received a one stop letter to submit further grounds which I have and also added my other child who is now 1.5yr included their passports and sadly my daughters medical records as she is diagnosed Autistic she is 6.5yrs. She's got her statement of special needs and is in a specialist school. I submitted a letter from her school to support I am her sole carer with their dad being away 80% of the year on duty and all the letters I could find this was submitted 6 Feb.

I have now received a request for more proof of relationship with their dad we are kind of rocky as he's grown tired of waiting for me to be able to travel but none the less we are working through things, The caseworker seems to be thorough as they stated they realize he is overseas a lot and might not have lots of documents I have submitted all the additional documents I had last week.

I am uncertain how much longer things will last with my partner we have known each other 14 years together 8yrs its sad to say I have sort of given up because he is has changed since his deployment suffering post traumatic stress so I just let him be and try to keep our household as happy as possible for now, the solicitor stated my application is now being considered on a discretionary basis so now its a waiting game to see what they say, It is very frustrating as I am 30 now and its half my life gone living this way, but I do believe in time I will be free.

Should I start by welcoming you and wishing you a happy new year.

Reading through your story, I cannot tell you that i feel what you are going through but trust me on behalf of everyone to say I do understand. It's not the ideal time to start falling apart after all that you have been through. It's only natural to feel stressed but stress comes to knock on the door when on the otherside your freedom awaits you.

I believe your one-stop notice is a good sign that your case is being looked into and that is perhaps the reason it generated the request of submission of more documents. From my observation on this forum, the request of more documents is always a good sign if you submitted exactly what was asked for and you should here from the maximum 2-3 weeks after submission. Sometimes sooner.

I believe your freedom has already been established and they are just connecting the dots before the set you off into the beautiful summer. There is a time to worry about everything and it's usually a step at a time, you, your beautiful daughters and finally your partner. We are all in it together and hold you also in prayer. Be still ma'am you are almost at the finish line and we are anxiously waiting on the good news. You never know, it could be this week.

Thank you for your kind words of encouragement, it is difficult for everyone I also know of others in similar position with no grounds to remain besides time spent. The additional documents requested where bills or tenancy in our name 2 years old or more luckily I had a few bills from 2011 I was to shred once I got a shredder I guess there was a reason I kept forgetting to get it from Argos lol

Hi everyone. I have been following this forum and I really need some information. If anyone can help please. I have booked a ticket for 23rd of March but my application is not yet back from UKBA. I applied as parent of a British Child. My application timeline:

Application Received By UKBA: 14/01/2014
Biometrics Letter Received by me: 29/01/2014 Dated: 27/01/2014
Biometrics submitted to UKBA: 29/01/2014
Extra documents required by case worker: Letter Dated: 4/02/2014 Received by me: 07/02/2014
Sent Extra Documents: 07/02/2014
Received by UKBA: 10/02/2014

I sent a letter before the end of february explaining to case worker that I have booked my air ticket and why I have to travel and that I need my application back as soon as possible. i.e. before my travel date.

The case worker who wrote me asking for extra documents also stated that he/she intends to deal with my application promptly if I submitted documents before 18/02/2014 which I did. 

I haven't heard anything from UKBA and its 09/March/2014 today. What does the case worker mean by promptly? What time frame am I looking at before I hear from them?

Subsequently, I am not required to be in a relationship with the mother of my baby which I am not as far as immigration Law is concerned because I have not been in a relationship with her for up two years. 

I sent a letter as part of the extra documents signed by the mother of my baby saying we are not in a relationship even though we live at the same address.

My question is; Will UKBA make checks on my address and find that we live together? Will UKBA expect me to have explained why we live together? If UKBA finds that we live together or finds that we are a linked to one address will they automatically deny my application solely on that or ask for explanation from me? If I am denied solely on the basis that myself and the mother of my baby are linked tosame address without asking for an explanation will that not mean that UKBA's reason for denial is very weak?

Will it be advisable that I withdraw my application if UKBA doesn't return my application? How do I fight family/private life from abroad? I need to travel. I really do. There's so much I need to do.

Note: My student visa expired 15/10/2013 and I put in my first application which was received by the UKBA 4/11/2013. It was returned with a letter dated 11/12/2013 as invalid. I re-submitted another application received by the UKBA 14/01/2014. The period between 11/12/2013 and 14/01/2014 is more 28 days. Does this mean I am considered as an overstayer? Will that have any effect on my application?

God had the answer for me and it came today. I got my documents back and a biometric card will follow soon. It was not that much of a long wait but an anxious one. Its finally over. God who started it will finish it. God has no abandoned project and will give everyone waiting favor in the eyes of men . Case workers will have no option but grant you leave to remain in Jesus name.

Never give up. Never get tired of writing them. Keep bombarding them with more evidence and letters explaining things to them.

Hi People, Thanks to this forum and everyone who kept posting even though I never got answers to my question. I assume no one had answers or similar experience but thanks for all your contributions.

Thanks to Miss A who tried to answer one of my queries and a big congratulations to you over you victory.

God had the answer for me and it came today. I got my documents back and a biometric card will follow soon. It was not that much of a long wait but an anxious one. Its finally over. God who started it will finish it. God has no abandoned project and will give everyone waiting favor in the eyes of men . Case workers will have no option but grant you leave to remain in Jesus name.

I applied as parent of a British Child FLR (FP) and had most documents but I was in a relationship with the mother of my baby even though we have not been in a relationship for up to two years and going with this fact I put in my application that I am not in a relationship with my baby's mama.

I also don't work and those were the only two factors that should have worked against me. I was expecting UKBA to say I have lied about my relationship but all glory to God everything went smoothly. I put my application myself without any solicitor. I didn't think a solicitor will make any difference to my application.

I BOOKED MY FLIGHT TICKET FOR 23RD OF March 2014 and didn't know when my application will be back. I kept bombarding UKBA with letters to consider my application as urgent and my last resort will be to withdraw my application. But thank God I didn't have to withdraw it.

In fact, as I received my documents today the case worker will be receiving a letter I sent him yesterday. I kept writing UKBA like every week since mid february until they met my request. Never give up. Never get tired of writing them. Keep bombarding them with more evidence and letters explaining things to them.

I actually called UKBA today and they said my application is yet to be completed. Suddenly, my application arrived in the post. I wonder how they update their systems. Anyway, I have my documents and I am good to go.
