PEO appointment

Post by Viewpoint » Thu Jul 10, 2014 1:34 pm

I have been living in the UK 4 years 9 months. I am planning to book PEO appointment for ILR now, using 90 days concession days.

First Tier1(G) stamped on : 19-07-2009
First entry in the UK : 30-09-2009 ( i.e 73 days later)

Will Case worker ask any question regarding this?

I don't think you will be questioned for coming late as you are within the 3 months grace period.

I am bit worry, because one of my friend of friend got rejected at PEO using 90 days concession rule when he applied the ILR.
Somebody saying, it is case worker decision.
Anyone applied ILR using 90 days concession rule and got approved it recently?

i am a little worried after reading a few posts suggesting issues with concession 90 day rule, especially after reading your post.
you mentioned that one of your friend's ILR was rejected , Can you provide details if it was mainly because of 90 day concession rule ?

My circumstances are :
First Tier 1 Visa stamp date 1 May 2010 ( valid for 2 years)
First Entry to the UK - 19 July 2010 ( 80 days , which is within the 90 days concession period)
First extension - 15 June 2012. ( postal application took time, hence the date, upto 15 June 2015 )
Looking forward to apply in April Last week 2015 for ILR * using the 90 day concession rule*

Let us know why was your friend's ILR rejected ?

I guess it might be any other reason (But he applied 90 concession period too). So,I'm not sure about that.
This forum says, somebody got ILR through 90 days concession rule.

Okay, There are many cases on the forum here who has successfully obtained ILR using the 90 day concession rule.

I am going to rely on it, and hopefully this should not cause an issue for me.

It is clearly documnted here

https://www.gov.uk/government/uploads/s ... eriods.pdf
The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days. This can occur
if the applicant is delayed travelling to the UK. The period of delay will not be counted as an
absence if it does not exceed 90 days. If the delay is more than 90 days, none of the period
between entry clearance being issued and the applicant entering the UK can be included in
the continuous period calculation.
