ILR for spouse english requirement/Amber please reply

Post by ILRTention » Tue Aug 05, 2014 11:44 am

Hello All,

Me and my wife will be applying for ILR together, I am on Tier 1 General and wife PBS dependent (got her visa 3 years ago and since then living in UK)

1- Her non-UK university is listed in the UKBA points calculator and awarded ‘35’ points for Masters / which I can also claim for English using same calculator.

Question: Does she still need UKNARIC comparability certificate?
And pass B1 exam?
Or getting a letter from university that it was taught in English would suffice?

No, a print out showing 20 or more points for qualification and 10 for English Skills should suffice B1 English in addition to LIUK.

Thanks Amber for your prompt response as always.

Also can you please clarify about 180 continuous residence rule it is for main applicant only. But what if the spouse has stayed 90+ or 180+ days outside UK in a single year, is that going to cause any problem?

There is nothing set in stone, absences should be limited and for good reason.

180 is not material but yes I would imagine absences less than 6 months wouldn't be an issue considering they're not declared for SET (M).

Thanks for your prompt responce. one last question :-)

We will be using SET (0)..as we both applying together.

As per your experience have you seen any dependent having ILR refused due to being outside country for more than 90 days> (specially in the last year just before applying ILR....actually she has to travel due to emergency mayb stay more than 90 days and will apply ilr within a week as soon she is returns to uk)

Apologies but can you elaborate bit more please.

You mean "Yes" for staying more than 90 days is an issue for a dependent?

There was one refusal I saw in the last 12 months in contrast to many successes.

Hi Amber,
I'm on Tier 2 General completed 5 years ready to apply for ILR. I was reading this thread about the KOLL requirement. I and my wife both passed LIUK test and now for the Languague requirement we used PBS calculator assuming we are Tier 1 applicant to check our qualification and English. PBS gave me 35 points for my Masters degree and 10 for English. For my wife her Bachelors degree is not showing any points while for English she gets 10 points. We then made few iterations and found that when the date of first successful Tier 1 application is changed to a date more recent one it gives her Bachelors degree 30 points. So my question is whether the above date matters if you want to demonstrate UKBA your qualification gets atleast 20 points and English 10 points? Which print outs do we need to keep just one showing the points for qualification and English or the whole PDF summary?
Thank you very much for your time.
