Hi guys,

I was wondering if you could help me please. I am a british citizien and recently got married to a Pakistani national. I have a question in relation to the rental income that is used towards the £18600 financial requirement.When the ECO calculates my rental income I am assuming it is the gross rental income before any expenditure or mortgage payments that they take in to account. Can anyone who has applied using rental income please let me know if I am correct? I am also employed, with a salary of £17,000, but the shortfall that remains I am wanting to cover with my gross rental income. I have read the Home office notes, and in regards to Annex FM the following guidance applies for rental income:

6.2. Property rental – further guidance
6.2.1. Appendix FM-SE specifies further requirements for property rental income:
20(c) Any rental income from property, in the UK or overseas, must be from a property that is: (i) owned by the person; (ii) not their main residence and will not be so if the application is granted, except in the circumstances specified in paragraph 20(e); and (iii) if ownership of the property is shared with a third party, only income received from their share of the property can be counted. (cc) The amount of rental income from property received before any management fee was deducted may be counted.

Part CC of the above implies to me that expenses do not need to be counted towards the rental income.

Please help me! All help will be very much appreciated. Thank you in advance!

That is correct management fee and mortgage will not be deducted.

The property cannot be the one you and your spouse intend to reside.

It is is joint owned, only your share of the property will be taken into account, and not the whole rent.

The purpose of the rule is not to calculate your income against your expenses but rather to see what your actual income is.

Hi there,

I just have another query which I hope you guys can help me with.

The rental income I receive is from a jointly owned property with my mother. Now, although I receive the rent and pay the mortgage I have been told that the income would be split on a 50/50 basis, which is fine, as my salary is £16,300, and 50% of the rental income is £2520, which is over the £18,600 requirement, but, the rent is received in cash by myself, and I have deposited it each month in to my bank account for only 9 months out of the 12, as I needed the cash for the other 3 months (November 2013 to January 2014), and didn't deposit it in to my bank account. I am worried about how the ECO will calculate my rental income, would it only be half of what I have deposited in to my bank account?

I will be providing other evidence such as rents receipt book, rents collection agreement signed by both myself and my tenant, a letter from my tenant confirming that they have been tenants for the last 2 years and being paying £420 rents per month, and I am also thinking of submitting my rental property pages of my 2014 tax return, as this covers the period 06.04.13 to 05.04.14,and would show my gross rents as £5040, which confirms that it has been declared to HMRC, and means it has been received by me?

In accordance to the notes on FM SE 1.7, It states the following:

3.4.2. Decision-makers are also able to grant an application despite minor evidential problems (but not where specified evidence is missing entirely).

I believe that I fall under the category above as not all the evidence is missing, and the 3 months of rental income that is not evident from the bank statements, is evident from the other sources of evidence I shall be providing. But on the other hand, I'm not too sure what the ECO would see as a minor evidential problems?

Any suggestions guys? Or has anyone been in this situation??
