This is an in-country spouse visa application. The English test was not on the list but it was a test above A1 level. The application was refused on the basis that the English requirement is not met as the test is not on the approved list. After refusal, a test was done that appears on the list and it has been lodged with the appeal grounds. Will the Tribunal disregard this or will they accept it ?
Would it be better to make a fresh application whilst the appeal is outstanding and submit the new test. is this possible?
What would be the better option?
