Dual citizenship travel from Australia

Post by OzSmurfette » Sun Oct 05, 2014 2:00 am

Hi there

My husband and I are planning on travelling to the UK next year (from Australia) for a period up to five years to work and travel. I have dual citizenship between Australia and the UK and hold a British passport. My husband is an Australian citizen and will be travelling on his Australian passport. I am confused however in relation the spouse visa which is what my husband will need to apply for to be able to accompany me on our travels.

If I understand it correctly, it is saying that I have had to have lived in the UK and be earning 18,600 pounds before he can qualify for a spouse visa. If that is the case, that will mean that I will have to travel to the UK first, establish myself and then for him to apply for a visa and then if it is granted, join me in the UK.

We aren't looking to reside in the UK for longer than 5 years. Australia is our home. We would though like to travel and work and see the country.

Has anyone else been in this scenario or can anyone provide guidance.

Thanks

You have three choices under UK law:

1) You can apply without arriving in the UK prior to your husband providing that either a) you (and it must be you) have earned more than the equivilent of £18,600 over the last year and you have a job offer waiting you which will earn more than that which will start within 3 months of arrival.

or

2) You have savings of £62,500 or more which have been in either of your accounts for more than 6 months.

or

3) You do as you described - come to the UK first, get a job, work for 6 months then bring him over.

There's also the EU law option:

Move together to another EU country (e.g. Ireland) for a period of 6-ish months ... exercise your treaty rights there (work) ... then move to the UK under EU law (which has no cost and no financial requirements).
