General question about EEA

Post by jonwade » Fri Oct 10, 2014 10:43 pm

Hi

Just reading the EEA rules with my Brazilian wife. The form - https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/270530/vaf5.pdf - suggests that English is not required (asks which language you would like the interview to be in, and also asks which language you used with an agent / rep when completing the form).

But the other document - http://www.parliament.uk/business/publications/research/briefing-papers/SN06353/changes-to-immigration-rules-for-family-members -about the process says that a person needs to demonstrate a good level of English - "intermediate English".

So, which is it? Need to be able to speak English to a good level, or not?

Also, it mentions a salary of £18600 is required by the UK resident - does this mean a married partner cannot come if you are only earning £16k?

Many thanks

Jon Wade.

Then unfortunately the second link posted giving the requirements for a spouse visa under UK regulations applies to you. The EEA route (the first link) is for those who are a married to an EEA national, i.e not British.
Your wife will have to pass the pre-entry A1 English test and your earnings as her sponsor must be a minimum of £18,600 per year.
Unless you have savings over £16,000 to meet any shortfall which have been held in an account for 6 months, the £18,600 is mandatory.

I'll move this thread to the family immigration forum. Come back with any questions you may have. If you're not able to meet the financial conditions, Google the Surinder Singh route to settlement and see if this is an option for you.
