LR continuous residence?

Hi Forum Member and Guru's

This request is for my friend!!!

She is thinking to apply LR next month and has a doubt whether she can apply at all? :? She came to UK in student visa 4Years and then PSW for 2 years. Then went to india and got entry clearance as Tier 2 Dependent in 2010 (0.5 years). She thinks just because she had an entry clearance again in 2010 her previous visas will not be counted towards the LR category (Some solicitor said this it seems)

time line below

Student - 4 years
PSW-2 years
Tier 2 Dep - 0.5 years (Entry Clearance to switch)
Tier 1 Dep - 3.5 years

No refusal or gaps in visa.

Please confirm whether she can apply or not?

Best would be if your friend (or you) can list the exact visa valid to and expiry dates for each.

Below is visa dates

Student - 4 years (dec 2004 to jan 2009)
PSW-2 years (feb 2009 to jan 2011)
Tier 2 Dep - 0.5 years (Entry Clearance to switch) (Jan 2011 to mar 2011)
Tier 1 Dep - 3.5 years (apr 2011 to mar 2016)

No gaps in visa

You mentioned no gaps in visa. But what abt between jan 2009 to Feb 2009 ?

Hope this gives better info

Student - 4 years (dec 2004 to jan 2009)

PSW-2 years (feb 2009 to jan 2011) "on-time postal application in Jan09 and received LTR in Feb09"

Tier 2 Dep - 0.25 years (Entry Clearance to switch) (Jan 2011 to mar 2011) "This visa was from Jan2011 to Nov2013 but switched to tier 1 G dependent along with main app switched in Apr 11"

Tier 1 Dep - 3.75 years (Apr 2011 to Mar 2016)

what date she left UK in Jan 2011 and whn she re enter after getting an entry clearance ??

If her single absences were less than six months and her total absences less than 18 months and she satisfies the other requirements, then she should be okay. Her entry clearance does not have to be in the same category as her previous leave.
